Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by PooFree Living (“we”, “us”, “our”). By using our website or engaging our services, you agree to be bound by these Terms.
1. Services
We provide residential and strata dog waste removal and related services (including bin cleaning where offered) within our service areas in New South Wales. Services are typically subscription-based (weekly, fortnightly, or custom) and subject to availability, site access, and work health and safety considerations.
2. Eligibility
- You must be 18 years or older to enter into an agreement with us.
- Your property must be located within our current service areas.
- Access must be safe and reasonable (e.g. gates unlocked, pets secured, hazards removed).
3. Customer Responsibilities
- Provide accurate booking details (address, number of pets, access notes, frequency).
- Ensure safe, unhindered access on the scheduled day and secure any aggressive animals.
- Notify us promptly of changes to contact details, pets on site, or service requirements.
- Keep lawns and access pathways reasonably maintained to allow safe work.
If we cannot access your property or conditions are unsafe (e.g. locked gate, dangerous dog, hazardous materials), the visit may be charged as completed.
4. Pricing & Payment
- Prices are in Australian Dollars (AUD) and include GST where applicable.
- Subscriptions are billed in advance via our secure payment provider (Westpac PayWay). We do not store full card details.
- Pricing may be updated with 14 days’ written notice for ongoing subscriptions.
- Invoices are payable by the due date shown; late or failed payments may result in suspension of services.
5. Cancellations, Pauses & Rescheduling
- Cancel anytime with 7 days’ written notice before your next billing cycle.
- No pro-rata refunds for services already rendered or missed due to access issues.
- We may pause or reschedule due to severe weather, public holidays, illness, or safety concerns. We’ll make reasonable efforts to service within the same week.
6. Health, Safety & Property Care
- We follow safe work practices and may refuse or discontinue work if conditions pose risk.
- We take reasonable care of lawns and gardens; minor disturbances can occur during waste removal.
- We may take time-stamped photos for quality assurance and service verification.
7. Liability
To the maximum extent permitted by law, we exclude liability for indirect or consequential loss. Nothing in these Terms excludes your rights under the Australian Consumer Law (ACL). Where liability cannot be excluded, it is limited to re-supply of the services or the cost of re-supply, at our election.
8. Indemnity
You indemnify us against claims, losses, damages, and expenses arising from your breach of these Terms, provision of inaccurate information, or unsafe site conditions.
9. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (including severe weather, outages, pandemics, or transport disruptions).
10. Privacy
We handle personal information in line with our Privacy Policy and the Australian Privacy Principles. Payment processing is handled securely by Westpac PayWay.
11. Intellectual Property
All website content, branding, and materials are our intellectual property. You may not reproduce or use them without written permission.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of NSW.
13. Changes to Terms
We may update these Terms from time to time by posting a new version on our website. Continued use of our services constitutes acceptance of the updated Terms.
